GENERAL TERMS AND CONDITIONS OF SALE

Any service taking place at the Golf de Hombourg implies acceptance of the following conditions:


1 - The order
All service orders must systematically be sent signed by the client by mail or email.

Any proposal not confirmed by one of these two methods will be considered void.
The order will be based on the number of guests confirmed by the organizer through signature of the commercial proposal and General Terms and Conditions, according to the above deadlines:
- 15 days before a family event (wedding, birthday, christening, etc.),
- 10 days before a professional event (evening party, dinner/lunch for more than 10 people, etc.),
- 5 days before a seminar or lunch/dinner.
After this deadline, the order will be based on the initial proposal sent to the client, prepared at their request and using their information, and signed by the client.
In any case, the number of guests used for invoicing cannot be less than 90% of the number of guests used as the basis for the order form.


" GOLF INTRODUCTION "
: For bookings using our golf instructors, confirmation must be received by email* at least 15 days before the session. We advise participants to wear casual clothing and flat shoes.
To make the most of the golf introduction, please be punctual, as the instructor will not be able to reschedule due to their client scheduling commitments. In the event of a partial session due to a delay of the group or some participants, invoicing will be based on the proposal accepted and signed by the client. The decision to cancel the introduction due to bad weather cannot be made solely by the instructor in charge of your group.
If an order number has been assigned by the client's purchasing department, the client must send it to us upon signing the quote and these Terms and Conditions. In the event of late payment due to a rejected invoice by the client because of the absence of the order number or any other information specific to the client's internal procedures, point 12 below will apply.


2 - The Service:
The establishment reserves the right to modify an offer with identical products or services without this resulting in a change in price.
The company retains sole control over the configuration of the rooms made available and the venues for the various events.
As several events of different natures may take place simultaneously, the establishment, unless explicitly stated otherwise in the quote, does not grant any exclusivity on the site.


3 - Schedules
The schedules provided in the offer are indicative only and may be subject to change without prior notice. Depending on the duration of the service, additional hours will be charged:
- 1st overtime period: from 1:00 AM to 3:00 AM: €100 including VAT per hour.
- 2nd overtime period: from 3:00 AM to 5:00 AM: €150 including VAT per hour.


4 - Responsibility
Customers of the Golf de Hombourg must respect the internal regulations as well as the customs and practices observed on the golf course.
Any damage inside or outside the establishment will be billed.
Customers accept that the establishment cannot be held responsible in the following cases:

Theft or damage committed in the restaurant's unguarded parking lot, incidents or accidents resulting from improper use of our facilities, are not our responsibility.
Furthermore, the supervision and responsibility of children rests entirely with their parents.
The establishment declines all responsibility for any accidents or incidents that may occur to children. Any incident, damage, or injury will be billed.
Confetti and glitter are prohibited in our establishment. Any cleaning or repair services, if necessary, will be subject to a minimum charge of €500 including VAT.


5 - Public drunkenness
The establishment, in accordance with the law, may decide to stop serving alcoholic beverages to any person who is clearly under the influence of alcohol; the manager of the Golf de Hombourg present in the establishment will be the sole judge of the condition of the person concerned.


6 - Noise Pollution
In accordance with the decree of December 15, 1998, concerning regulations applicable to establishments or premises open to the public and regularly broadcasting amplified music, the following provisions apply:
- Sound entertainment must be exclusively inside the buildings,
- Sound entertainment equipment must be powered exclusively by the dedicated electrical outlet.
- Sound level limited to 105 decibels after 10:00 PM.
This regulation has a dual purpose:
- to protect the hearing of the public frequenting the establishment by limiting the average sound level, and to protect the neighborhood from potential disturbances.


7 - Pricing
The price expressed in Euros on the signed quote is fixed. It cannot be modified after acceptance of the quote. Prices quoted excluding taxes will be subject to the applicable VAT rate.


8 - Deposits
All orders must be confirmed by one or more deposits as follows:
A booking deposit of 30% of the total cost of the service will be collected on the day of booking.
Any service exceeding €3,000 (including VAT) will require a 50% deposit and must be paid in full 30 days prior to the event.


9 - Invoicing
Invoicing will be based on the number of guests confirmed by the organizer upon signature of the commercial proposal and General Terms and Conditions, according to the above deadlines:
- 15 days before a family event (wedding, birthday, christening, etc.),
- 10 days before a professional event (evening party, dinner/lunch for more than 10 people, etc.),
- 5 days before a seminar or lunch/dinner

After this deadline, or if the aforementioned documents have not been signed, the invoice will be based on the initial proposal submitted to the client, prepared at their request and using their information, and signed by the client.
In any case, the number of guests used for invoicing cannot be less than 90% of the number of guests used as the basis for the order form.

The billing address and payment terms must be included on the order form.

10 - Additional services and billing

In addition to any hourly surcharges, additional charges will be applied based on the order form and/or actual consumption during the event.
Setting up decorations (table or room) by our staff will incur a minimum charge of €12 including VAT per guest.
A corkage fee of €12 including VAT per opened bottle will apply to any drinks brought in by the guest.

Group menu: The menu typically includes a starter, a main course, and a dessert for all guests. Any multiple choices, for whatever reason, will incur a 30% surcharge on the original menu price.


11 - Payment
The balance of the invoice (total cost of services minus any deposit received) must be paid within 72 hours prior to the service being provided. Only companies will have payment terms upon receipt of invoice. No discount will be granted for early payment.

12 - Late payment

Any invoice not paid within the deadlines indicated above will incur late payment penalties at a rate of 1.5 times the legal interest rate in effect on that date, starting from the first day of delay.
Furthermore, as a penalty clause, the client will pay a sum equal to 15% of the total amount of the invoice in question, with a minimum of €100 including VAT, without prejudice to the Golf de Hombourg right to claim compensation for any damages incurred.

 

13 - Cancellation conditions

It is agreed between the parties that neither the deposit nor the balance will be refunded for any reason whatsoever
on the part of the client. In the event of cancellation by the client, a cancellation fee will be charged.

Up to 90 days before the event: 30% of the total service cost – deposit paid.
From 89 to 60 days before the event: 50% of the total service cost – deposit paid.
From 59 to 25 days before the event: 75% of the total service cost – deposit paid. Less than 25 days before the event: 100% of the total service cost – deposit paid.

The deposit and the balance will be fully refunded only in the event that the service cannot be provided by the Golf de Hombourg.


14 - Modification of the General Terms and Conditions of Sale.
These general terms and conditions of sale may be modified at any time. In this case, the Golf de Hombourg will send the client the modifications by email before the start of services. The new version of the general terms and conditions of sale will then apply to the relationship between the parties.

 

15. Mediation.

After contacting the service (after-sales, post-trip) and in the absence of a satisfactory response or in the absence of a response within 60 days, the customer can contact the tourism and travel mediator whose contact details and procedures for contacting them are available on his website www.mtv.travel.

 

16. Election of domicile.

All written communications between the parties must be sent to Golf de Hombourg by email with read receipt to direction@golfdehombourg.fr and for the client to the address or email contact indicated in the booking file.

 

17. Law applicable to the contract.

This contract is governed by French law. Any dispute between the parties relating to the interpretation or performance of this contract that cannot be resolved amicably shall be brought before the competent courts of Mulhouse. In the event of a dispute, any undisputed amounts due must be paid by the due date.
